Great news today for citizens of Los Angeles: LA Sheriff Lee Baca is taking an increased stand against mistakenly arresting innocent people. On the heels of reports that hundreds of innocents have been wrongfully accused and imprisoned in Los Angeles County jails, changes have been implemented to prevent future errors.

Bail Bonds Varieties: Cash Bonds, Surety Bonds, and Property Bonds

This week, we will explain the difference between the various types of bail bonds that exist, namely cash bonds, surety bonds, and property bonds.

Cash Bonds

The most basic of the three, cash bonds do not require a bail bondsman at all. Instead, they are negotiated through the court.

After an arrest, the defendant goes through a booking process which includes appearing before a judge, who sets the bail cost. If the person doing the bailing has the full amount in cash, that person can forgo using a bail bonds business and pay the entire cash bond to the court.

The advantage of using a cash bond is that the bailer will be compensated the whole amount at the conclusion of the trial, regardless of the verdict.

The downside is that the bail is usually quite high and court cases can drag along. The average person cannot afford to have that much money tied up for so long. This is where surety bonds play a huge role.

What are Surety Bonds?

Surety bonds are posted by a reputable, licensed bail bonds agent, who provides the cash in exchange for a 10% fee, which is non-refundable. Why would bail bonds businesses pay 90% of the cash bond?

Because they are assured a return of the full amount at the conclusion of the trial, as long as the defendant attends all court dates. So the 10% is pure profit.The disadvantage versus a cash bond is that surety bonds require you to pay 10%, whereas cash bonds end up being free.

Conversely, the easy thing about surety bonds is that your money is not tied up in the bail cost, waiting for the trial. This allows you to have extra funds for a defense attorney and other court costs.

Property Bonds

Property bonds are similar to cash bonds, but are more seldom used. Rather than pay the court the entire amount in cash, they will allow for some property to be used as collateral for release.

Should the arrestee fail to appear before the judge or flees the state, the court may foreclose on the property to obtain the full cost of bail.

Lindsay Lohan Legal Roller Coaster Continues

Hollywood’s favorite celebrity jailbird is back at it. Again. If you have your head in the sand, or if you’re like me and start getting a ringing migraine whenever Miss Lohan’s name is mentioned, then you may not be informed about the exciting week she is currently having.
Still serving punishment following a pair of DUI arrests a few years ago and the theft of a necklace from early 2011, on October 19th Lindsay, of Parent Trap and Mean Girls fame (and nothing else remotely worthwhile), was sent to jail for failing to fulfill the terms of her probation which required her to perform community service. She was released on Los Angeles bail bonds that were set at $100,000 the same day.

As if answering the critics who believe her latest arrest was merely a publicity stunt, Lindsay announced on Monday that she completed a nude spread for Playboy Magazine that afternoon. Paparazzi snapped photographs of her leaving the Playboy Mansion, where her mother Dina said the shoot was successful. I just hope the magazine shows her wearing nothing but handcuffs.

If getting arrested, bailed out, and taking naked pictures wasn’t enough excitement for the young starlet (term used loosely), Lohan also began her community service to make up for the community service she previously missed (is that like an interest rate?) on Tuesday and Wednesday.

In some cruel Halloween-inspired twist of fate (or justice) Lohan has to work at the Los Angeles County Morgue. Sppppooooooookkkkkkyyyyyyy!

Well, at the end of the day I hope Lindsay Lohan learns her lesson and becomes the Leading Lady with the marvelous movie career that America envisioned her having as a teen star, and then we meet at a bar and exchange numbers and get married in Vegas. Which might be even odds with her burning out and being found OD’d by a maid in a hotel bathroom.

Let this be a lesson to all of the kid actors and the parents who push them.
